The scale is hard to overstate. For the 2018 compliance year, the agency granted 31 exemptions totaling 1.43 billion ethanol-equivalent gallons — a wave that Energy Information Administration data showed cut 7.4 percent out of the total renewable volume obligation of 19.29 billion gallons. The 2025 decision exceeds even that benchmark, making it the largest single-year exemption grant since the 2017 compliance year, when a similar surge of waivers first shook the program.
The announcement did not land in a vacuum. In the week before it, rumors about the size of the waiver circulated widely enough that the agency felt compelled to accuse outside reporting of spreading "inaccurate and misleading reporting" that drove "significant volatility in the RIN market." If it is structural, the reallocation becomes a patch on a leaking vessel, and the market will keep discounting future RFS volumes until the exemption process itself is narrowed.
The Politics: Farm States, Refiners, and a Midterm Timing Problem
The immediate beneficiaries are the 29 exempted refineries and, by extension, the broader refining sector, which faces lower compliance costs than the March rule implied. Even so, the American Fuel & Petrochemical Manufacturers objected, arguing that granting 2025 exemptions "significantly above" the agency's projection "would be a significant step backward," and that reallocating those volumes to non-exempt refiners "would compound the problem" and "inject uncertainty into the fuels marketplace." That is the refiners' version of the story: certainty about the rule is worth more than the exemption itself.
The costs are concentrated in farm states. Clean Fuels Alliance America estimated that without reallocation, biodiesel and renewable diesel producers could lose billions of gallons of demand over two years and soybean farmers could lose as much as 40 cents per bushel; the group put total farmer exposure at $7.5 billion. The American Soybean Association said high exemptions could erase roughly 500 million gallons of biodiesel and renewable diesel demand and cost soybean growers about $1 billion in lost revenue. Four state attorneys general — Iowa, Nebraska, South Dakota and Missouri — warned the EPA that granting exemptions to refiners posting record profits violates the RFS statute.
That alignment puts the White House in an awkward position heading into November. The same administration championing lower fuel costs is delivering a decision that farm-state lawmakers argue transfers income from rural producers to refiners. The Renewable Fuels Association's chief executive, Geoff Cooper, framed it as a choice: "At a time when oil refiners are reporting record-high profit margins, gasoline supplies are tightening, and consumers are paying record-high prices at the pump, the administration should focus on efforts to increase — not decrease — the domestic production and use of more affordable biofuels like ethanol."

By committing to reallocate 100 percent of the exempted volume into 2026 and 2027, the agency is effectively saying the waivers change the timing of demand, not its level. If the October rulemaking delivers the full reallocation promptly, net renewable fuel demand over the three-year window is unchanged, and the 2025 RIN selloff is just a temporary dislocation that unwinds once the new volumes are locked in.

But the counter-thesis rests on two assumptions the market has reason to doubt. First, it assumes the reallocation rule will be finalized quickly and fully; the agency has said only that it will propose reallocation before the end of October, leaving the final number and timing open. Second, it assumes the market will treat future reallocated volumes as equivalent to current mandated volumes, when the whole point of the RIN market is that near-term, certain demand trades at a premium to future, rulemaking-dependent demand.
The signal that would falsify the bearish read is specific and observable: if the EPA finalizes 100 percent reallocation of the 1.76 billion RINs into the 2026-2027 obligations by the end of 2026, and D6 RINs recover to the $2.40 to $2.60 range they traded in before the exemption rumors began, the market will have confirmed that the damage was cyclical and temporary. If reallocation is delayed, scaled back, or RINs remain depressed below $2 despite it, the structural read wins.
What to Watch: Three Scenarios Across Time Horizons
In the near term, the path is clear. Compliance has been pushed to October 1, giving obligated parties a month to account for the extra credits, and the reallocation proposal is due before the end of October. That window will dominate RIN trading: every headline about the scope of reallocation will move prices, and the 1.2 billion to 1.8 billion RIN range the market pre-positioned for is now the reference band for what "full" looks like.
Over the medium term, three scenarios frame the risk:
- Base case: The EPA finalizes full 100 percent reallocation in the October rulemaking. RIN prices stabilize in the low $2s, ethanol and biodiesel margins stop deteriorating, and the political heat in farm states fades before November.
- Upside for biofuels: Reallocation exceeds expectations or is accelerated, and the DOE tightens its hardship methodology. D6 RINs recover toward pre-rumor levels, and the mandate regains credibility as a demand floor.
