The Federal Police had previously indicted Tagliaferro four months before the formal complaint, citing that he passed confidential information to the press in April 2024. The Attorney General also noted that Tagliaferro threatened to release further confidential information from abroad in July 2025, constituting coercion in the course of the process.
Tagliaferro's defense has denied the allegations, describing the charges as persecution. They claim he was subjected to illegal seizure of his cellphone and that he only confirmed information already present in messages. The defense also stated that Tagliaferro fears for his life but intends to reveal information that they say deserves legal scrutiny for the country's moralization.
The case has drawn significant attention due to Tagliaferro's previous role as an advisor to Minister Moraes and the political implications surrounding the leaks, which have been linked to attempts to discredit the judiciary and electoral authorities in Brazil.
